Terms of Service

These Terms & Conditions apply to all services provided by Picture This Fotoautomatica (“we”, “us”, “our”). By accepting a quote, paying a deposit, or confirming a booking, the client (“you”, “the Client”) agrees to be bound by these Terms & Conditions.

 

1. OUR SERVICES

Picture This Fotoautomatica provides premium photobooth hire services for weddings, private celebrations, corporate events, and brand activations.

Our standard service includes:

  • Delivery and professional setup of the photobooth

  • Unattended, self-service operation for the agreed hire duration (typically 5–6 hours)

  • Collection of equipment following the event

Unless otherwise agreed in writing, photobooths are supplied without an on-site attendant.

2. BOOKINGS & PAYMENT

2.1 Securing Your Booking

A booking is confirmed upon receipt of a 50% non-refundable deposit.

2.2 Final Payment

The remaining 50% balance is due no later than four (4) weeks prior to the event date.

2.3 Late Payment

If the final balance is not received by the due date, we reserve the right to cancel the booking, release the event date, and retain the deposit.

2.4 Pricing

All prices are quoted in Australian Dollars (AUD). GST will be applied where required by law.

3. CANCELLATIONS & DATE CHANGES

3.1 Client Cancellations

  • More than 8 weeks prior to the event: deposit retained

  • 4–8 weeks prior to the event: 50% of the total booking fee payable

  • Less than 4 weeks prior to the event: 100% of the total booking fee payable

3.2 Date Changes

Requests to reschedule are subject to availability. Where a suitable alternative date cannot be accommodated, standard cancellation terms apply.

4. DELIVERY, ACCESS & VENUE REQUIREMENTS

4.1 The Client is responsible for ensuring:

  • Clear, safe, and unobstructed access for delivery and collection

  • Adequate space for setup and operation

  • Venue approval for photobooth installation and use

4.2 We cannot be held responsible for delays, interruptions, or reduced service caused by venue restrictions, access limitations, or conditions beyond our control.

5. POWER & INTERNET REQUIREMENTS

5.1 The photobooth requires:

  • A standard 240V power outlet within reasonable distance of the setup location

  • A stable Wi-Fi connection where digital sharing, uploads, or live features are included

5.2 The Client is responsible for ensuring power and Wi-Fi availability at the event location.

5.3 Picture This Fotoautomatica is not responsible for service interruptions caused by power failure, unstable internet connections, or venue-imposed limitations.

6. CARE OF EQUIPMENT

6.1 Responsibility for the photobooth transfers to the Client from the time of delivery until collection.

6.2 The Client agrees to take reasonable care to protect the equipment from damage, misuse, theft, or interference by guests or third parties.

6.3 Any damage, loss, or excessive wear beyond normal use may result in repair or replacement charges.

7. APPROPRIATE USE

7.1 The photobooth must be used respectfully and in accordance with all applicable laws, venue rules, and safety requirements.

7.2 We reserve the right to disable or suspend operation where misuse, safety concerns, or unlawful activity is identified.

7.3 The Client is responsible for the conduct of all guests, attendees, and third parties who use or interact with the photobooth during the agreed hire period.

7.4 The Client acknowledges that the photobooth is provided on an unattended, self-service basis and agrees to take reasonable steps to ensure guests use the equipment safely and appropriately.

7.5 Picture This Fotoautomatica shall not be held liable for loss, damage, injury, or misuse arising from guest behaviour during the hire period, except where required by law.

7.6 The Client remains liable for any loss or damage caused by guests, invitees, or third parties during the agreed hours of use.

8. SERVICE INTERRUPTION & TECHNICAL ISSUES

8.1 While every effort is made to ensure reliable operation, unforeseen technical issues may occasionally occur.

8.2 In the event of a malfunction or interruption due to unforeseen circumstances, Picture This Fotoautomatica will make reasonable efforts to rectify the issue promptly.

8.3 Where required, a staff member may be dispatched to attend the event and address the issue.

8.4 If the photobooth is unavailable for use for a verified period due to a technical fault attributable to our equipment, the Client may be eligible for a partial refund or discount, calculated on a pro-rata hourly basis for the affected downtime.

8.5 No refund or discount will apply where the interruption results from:

  • Venue power failure or restrictions

  • Internet or network outages beyond our control

  • Misuse, interference, or damage caused by guests or third parties

  • Environmental or safety conditions preventing operation

8.6 Any applicable refund or discount will be assessed after the event and processed within a reasonable timeframe.

9. LIMITATION OF LIABILITY

9.1 To the maximum extent permitted by law, Picture This Fotoautomatica shall not be liable for indirect, incidental, or consequential loss.

9.2 Our total liability is limited to the total amount paid by the Client for the booking.

9.3 Nothing in these Terms limits or excludes rights available under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

10. INSURANCE

Picture This Fotoautomatica holds Public Liability Insurance appropriate for event hire services. This does not extend to damage caused by client negligence or misuse.

11. IMAGES, CONTENT & PRIVACY

11.1 Unless otherwise advised in writing prior to the event, images captured may be used for portfolio, marketing, and promotional purposes.

11.2 Personal information is handled in accordance with the Privacy Act 1988 (Cth) and will not be shared with third parties except where required by law.

12. FORCE MAJEURE

We are not liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to extreme weather, government restrictions, power outages, or equipment failure beyond reasonable mitigation.

13. LEGAL COMPLIANCE

Services are provided in accordance with applicable Australian and Victorian legislation, including:

  • Australian Consumer Law

  • Occupational Health and Safety Act 2004 (Vic)

14. GOVERNING LAW

These Terms & Conditions are governed by the laws of Victoria, Australia, and disputes are subject to the jurisdiction of Victorian courts.

15. ACCEPTANCE

Acceptance of a quote, payment of a deposit, or confirmation of a booking constitutes acceptance of these Terms & Conditions.
